Any use of the trademarks, website content, or promotional materials for commercial purposes is strictly prohibited. Any abuse or infringement of intellectual property rights will be reported to the competent authorities and prosecuted according to law.
1. DEFINITION AND SUBJECT OF THE CONTRACT
1.1 – This agreement (“Contract”) is a distance contract pursuant to Articles 50 et seq. of Legislative Decree no. 206 of 6 September 2005 (“Consumer Code”). The Contract concerns the sale of movable goods between La Provenzale S.r.l. (owner of the La Provenzale trademark) (“La Provenzale”) and the consumer (the “Customer”).
The Contract is concluded directly through the acceptance by La Provenzale of a purchase proposal made by the Customer via the internet, following the invitation to offer published on the website www.laprovenzale.it and/or through other remote sales systems of La Provenzale, according to the procedures described in Article 3 below.
1.2 – These General Terms and Conditions of Sale (“General Conditions”) and, in particular, the information referred to in Article 52 of the Consumer Code, as provided by La Provenzale and shown on the Website, shall remain valid and effective until amended and/or supplemented by La Provenzale. Any amendments and/or supplements to the General Conditions shall take effect from the date they are made public and shall apply to sales made from that date onward. The latest updated version of the General Conditions is available on the Website.
2. SALES PRICES
The sales prices of the products displayed on the Website and/or through any other remote sales systems of La Provenzale include VAT and all other applicable taxes.
3. PURCHASE AND PAYMENT METHODS
3.1 – A Contract concluded by telephone is finalized when the Customer (who contacts La Provenzale by telephone and, on that occasion, submits a purchase proposal providing the necessary data for the registration process, purchase order, and chosen payment method) is informed that the proposal has been accepted.
3.2 – For purchase proposals submitted via the Website, the Customer will receive a summary email from La Provenzale confirming that the purchase proposal is being processed and will be deemed accepted unless La Provenzale communicates otherwise by email or telephone within three (3) calendar days from receipt of the summary email. After this period, the online Contract shall be considered finalized.
3.3 – Orders will be processed within 24 hours from receipt of the order confirmation email.
3.4 – Payments may be made via PayPal, bank transfer in advance, or cash.
4. PRODUCT DELIVERY – COMPLAINTS
4.1 – La Provenzale delivers products to the address provided by the Customer within 3 business days for shipments within Italy and within 7 business days for international shipments.
4.2 – The costs payable by the Customer are indicated at checkout and during payment.
The shipping cost within Italy is €6.90 and free for orders over €50.00. For international shipments, the cost varies depending on the destination country.

5. PRODUCT AVAILABILITY
La Provenzale accepts Customer orders within the limits of the quantities available in stock. Therefore, the acceptance of the Customer’s purchase proposal is subject to product availability. La Provenzale undertakes to promptly inform the Customer of any unforeseen stock shortages due to excessive demand or other causes.
6. WARRANTIES AND SUPPORT
For products purchased by the Customer, La Provenzale applies the legal provisions concerning warranties and after-sales support for the sale of consumer goods.
7. CUSTOMER OBLIGATIONS
The Customer declares and guarantees that:
(i) they qualify as a consumer under Article 3 of the Consumer Code;
(ii) they are of legal age;
(iii) the data provided for the execution of the Contract are true and correct.
8. RIGHT OF WITHDRAWAL
8.1 – The Customer has the right to withdraw from the Contract, without penalty and without giving any reason, within 14 days from receipt of the products. The Customer may exercise the right of withdrawal within this period by notifying La Provenzale by telephone or by written communication sent to the company’s registered office as specified in Article 4, by registered letter with return receipt, telegram, email, or fax.
8.2 – The Customer wishing to exercise the right of withdrawal must return the products to the following address within 14 days from receipt of the products:

Pursuant to Article 55, paragraph 2, of the Consumer Code, the Customer shall have no right of withdrawal in the following cases: – supply of sealed products opened by the Customer; – supply of products which, by their nature, cannot be returned or are liable to deteriorate or expire rapidly (e.g., food products).
8.3 – Return shipping costs are borne by the Customer.
La Provenzale will refund, within 7 days from receipt of the returned products:
(i) the full price paid by the Customer if the product is returned complete with all parts and functionality; or
(ii) the portion of the price corresponding to the product actually returned, if the product has been used or damaged in a way that significantly reduces its value.
8.4 – Refunds from La Provenzale to the Customer will be made by bank transfer.
