Any use of the trademarks, website content, or promotional materials for commercial purposes is strictly prohibited. Any abuse or infringement of intellectual property rights will be reported to the competent authorities and prosecuted according to law.
1. DEFINITION AND PURPOSE OF THE CONTRACT
1.1 – This agreement ("Contract") is a distance contract pursuant to Articles 50 et seq. of Legislative Decree no. 206 of September 6, 2005 ("Consumer Code"). The Contract concerns the sale of movable goods between La Provenzale S.r.l. (owner of the La Provenzale trademark) ("La Provenzale") and the consumer (the "Customer").
The Contract is concluded upon acceptance by La Provenzale of a purchase proposal submitted by the Customer via the internet, following an invitation to offer published on the website www.laprovenzale.it and/or through other remote sales systems of La Provenzale, according to the procedures described in Article 3 below.
1.2 – These General Terms and Conditions of Sale ("General Conditions") and, in particular, the information required under Article 52 of the Consumer Code, as provided by La Provenzale and displayed on the Website, remain valid and effective until amended and/or supplemented by La Provenzale.
Any amendments and/or additions to the General Conditions shall take effect from the date they are communicated to the public and shall apply to sales made from that date onward. The latest updated version of the General Conditions is available on the Website.
2. SALES PRICES
The sales prices of the products displayed on the Website and/or through other remote sales systems of La Provenzale include VAT and all applicable taxes.
3. PURCHASE AND PAYMENT METHODS
3.1 – The Contract concluded by telephone is finalized when the Customer (who contacts La Provenzale by phone and submits a purchase proposal by providing the necessary personal data, purchase order information, and chosen payment method) receives confirmation that the proposal has been accepted.
3.2 – For purchase proposals submitted via the Website, the Customer will receive a confirmation email from La Provenzale indicating that the purchase proposal is being processed and will be deemed accepted unless La Provenzale communicates otherwise by email or telephone within three (3) calendar days from receipt of the confirmation email. After this period, the online Contract is considered finalized.
3.3 – Orders will be processed within 24 hours from the receipt of the order confirmation email.
3.4 – Payments may be made via PayPal, bank transfer in advance, or cash.
4. PRODUCT DELIVERY – COMPLAINTS
4.1 – La Provenzale delivers products to the address provided by the Customer within 3 business days for deliveries in Italy and within 7 business days for international shipments.
4.2 – The shipping costs payable by the Customer are displayed at checkout and during payment.
The shipping cost in Italy is €6.90 and free for orders over €50.00.
For international shipments, the cost varies depending on the destination country.

5. PRODUCT AVAILABILITY
La Provenzale accepts Customer orders within the limits of available stock. Therefore, acceptance of a Customer’s purchase proposal is subject to product availability in stock.
La Provenzale undertakes to promptly inform the Customer of any unforeseen stock shortages due to high demand or other causes.
6. WARRANTY AND CUSTOMER SUPPORT
For products purchased by the Customer, La Provenzale applies the rules on warranties and after-sales assistance as provided by current legislation governing the sale of consumer goods.
7. CUSTOMER OBLIGATIONS
The Customer declares and guarantees that:
(i) they qualify as a consumer under Article 3 of the Consumer Code;
(ii) they are of legal age;
(iii) the data provided for the execution of the Contract are true and correct.
8. RIGHT OF WITHDRAWAL
8.1 – The Customer has the right to withdraw from the contract without penalty and without specifying any reason within 14 days from receipt of the products.
The Customer may exercise the right of withdrawal within this period by notifying La Provenzale by phone or by written communication sent to the company’s registered office (as specified in Article 4) via registered letter with acknowledgment of receipt, telegram, email, or fax.
8.2 – The Customer wishing to exercise the right of withdrawal must return the products to the following address within 14 days from receipt:

Pursuant to Article 55, paragraph 2, of the Consumer Code, the Customer is not entitled to withdraw in the following cases:
– supply of sealed products that have been opened by the Customer;
– supply of products which, by their nature, cannot be returned or are liable to deteriorate or expire rapidly (e.g., food products).
8.3 – Return shipping costs are borne by the Customer.
La Provenzale will refund, within 7 days from receipt of the returned products:
(i) the full price paid by the Customer if the product is returned complete with all parts and functionality; or
(ii) the portion of the price corresponding to the value of the product actually returned, if the product has been used or damaged in a way that significantly reduces its value.
8.4 – Refunds to the Customer by La Provenzale will be made by bank transfer.
