1. DEFINITION AND OBJECT OF THE CONTRACT1.1 - This contract ("Contract") is a distance contract pursuant to art. 50 and ss. of Legislative Decree dated 6 September 2005, n. 206 ("Consumer Code"). The Contract concerns the sale of movable property between La Provenzale Srl (owner of La Provenzale brand) ("La Provenzale") and the consumer (the "Customer").
The contract is concluded directly through the acceptance of a purchase proposal issued by the customer via the internet, following the invitation to offer content on the website ………………………….(the site) and /or through other distance selling systems of La provenzale, on the basis of the methods described in article 3.
1.2 These general conditions of sale ("General Conditions") and, in particular, the information referred to in art. 52 of the Consumer Code, as provided by La Provenzale, and reported on the Site, will remain valid and effective until they are modified and / or integrated by La Provenzale. Any changes and / or additions to the General Conditions will be effective since the date they will be communicated to the public and they will be applied to sales made from that date. The latest updated version of the General Conditions is the one available on the Site.
2. SALE PRICES2. The sales prices of the products shown, on the Site and / or through any other La Provenzale distance selling systems, include VAT. and any other tax.
3. PURCHASE AND PAYMENT METHODS
3.1 - The Contract by telephone is finalized by communicating to the Customer (who has contacted La Provenzale by telephone and made on that occasion a purchase proposal, providing the operator with the necessary data for the procedure for registering his name, the purchase order and the payment method chosen) that the proposal is accepted.
3.2 - In the event of purchase proposals sent through the Site, the Customer will receive a summary e-mail from La Provenzale, with which he will be informed that his purchase proposal is being processed and will be deemed accepted, unless otherwise communication by e-mail or telephone sent by La Provenzale within 3 (three) calendar days from the receipt of the summary e-mail. Once this term has elapsed, the Agreement via the Internet is to be considered completed.
3.3 - Orders will be processed within 24 hours of receiving the purchase order summary email.
3.4 - Payments can be made by PayPal payment method, prepayment bank transfer, cash.
4. DELIVERY OF PRODUCTS - COMPLAINTS
4.1 – la provenzale delivers the products to the address indicated by the customer within 3 working days for shipments in Italy and within 7 working days for shipments abroad.
4.2 - The costs that the customer must support are indicated at the checkout time and payment.

For international destinations, the cost varies depending on the destination country.

5. PRODUCTS AVAILABILITY La Provenzale accepts customer orders within the limits of the required quantities products available in stock. Therefore, the acceptance by La Provenzale of the purchase proposal submitted by the Customer is subject to the availability of the products in stock. Provenzale undertakes to promptly notify the customer of any unforeseen depletion of stocks due to excess demand or other causes.
6. WARRANTIES AND ASSISTANCEFor products purchased by the customer, the rules on guarantees and assistance relating to the sale of consumer goods are applicable to La Provenzale.
7. CUSTOMER OBLIGATIONSThe Customer declares and guarantees: (i) to be a consumer in accordance with the provisions of art. 3 of the Consumer Code; (ii) to be adult; (iii) that the data the customer provided for the execution of the Contract are correct and true.
8. RIGHT OF WITHDRAWAL8.1 - The Customer has the right to withdraw from the contract entered into, without any penalty and without specifying the reason, within 7 days of receipt of the products. The Customer may exercise the right of withdrawal, within the aforementioned term, by showing it by phone or by a written communication at the La Provenzale office pursuant to art. 4, to be sent by registered letter or by telegram, telex, e-mail or fax.
8.2 - The customer who intends to exercise the right of withdrawal must return the products to the following address La Provenzale Srl Via Garibaldi, 70 82029 San Marco dei Cavoti (BN), within 7 days of receipt of the products. Pursuant to article 55, second paragraph of the Consumer Code, the Customer will not have the right of withdrawal in the following cases: - supply of sealed products, opened by the Customer; - supply of products that by their v nature cannot be returned or are liable to damage or rapidly deteriorate (e.g. foodstuffs..)
8.3 - The costs of products returning are charged to the customer. La Provenzale will return, within 7 days from the date of receipt of the products by the Customer: (i) the full price paid by the Customer in case of return of the product complete with all its parts and features; namely the part of the price equivalent to the product actually returned by the Customer who has consumed the product in an appreciable way and / or in a such way to significantly diminish its value.
8.4 - The return of the money by La Provenzale to the customer will occur by bank transfer.
